Annual Move Laws, Regulations and Requirements Related to Permanent and Classified Permanent Records

Our Nation’s progress depends on the free flow of information both within the government and to the American people.  National defense has required that certain information be maintained in confidence in order to protect our citizens, our democratic institutions, our homeland security, and our interactions with foreign nations. 

Agency records which have been identified as classified permanent records are subject to many laws and regulations, including the following:

Permanent records must be transferred to the ÍþÄá˹ÈËÓéÀÖ³¡ of the United States when:

(a) The records are eligible for transfer based on the transfer date specified in a NARA-approved records schedule, or

(b) The records have been in existence for more than 30 years (see also § 1235.14).

Agencies must transfer to the ÍþÄá˹ÈËÓéÀÖ³¡ of the United States records that have been scheduled as permanent on an SF 115, Request for Records Disposition Authority records that are designated as permanent in a GRS; and, when appropriate, records that are accretions to holdings (continuations of series already accessioned.) 3/3/2022
